Mastering Criminal Procedure, Volume 1: The Investigative Stage provides a concise treatment of the relevant federal constitutional doctrines that guide and constrain interactions between the police and individuals in the investigation of criminal conduct. The book provides an overview of the criminal process and the constitutional sources of the criminal procedure rules, including different approaches to constitutional interpretation. The Second Edition updates the analysis with the latest Supreme Court decisions. The focus is on the Fourth, Fifth, and Sixth Amendments as they relate to the warrant requirement for searches, exceptions that allow warrantless searches, the seizure of evidence and individuals, and the interrogation of suspects. The book covers the primary topics that arise in the typical law school criminal procedure course, including when the warrant requirement applies, the process for obtaining a valid warrant, the operation of the exclusionary rule, the range of exceptions to the warrant requirement, and arrests and other seizures of individuals and resultant searches of the person. The authors have experience as prosecutors and defense counsel, and have written extensively in the fields of criminal law, criminal procedure, and evidence.

Marketing Ethics & Society PDF
By:Lynne Eagle,Stephan Dahl
Published on 2015-09-15 by SAGE

Marketing, while essential to organisational success, is arguably one of the most controversial aspects of business management. Criticisms of marketing’s impact range from fostering materialism and unsustainable consumption patterns through to the use of deception, stifling of innovation and lowering of quality, to name but a few. Taking a holistic and international perspective, this book critically examines the ethical challenges marketing faces and explores strategies marketers can use to respond to those challenges. The book examines specific aspects of marketing activities, such as ethical considerations in relation to young consumers, potentially harmful products and criticism of the societal impact of medical, arts and tourism marketing activities. It then combines these with wider discussions of frameworks that enable marketers to respond to ethical challenges, supplemented by discussions of cross-cultural and international perspectives, consumer responses and ethical consumption movements as well as shifting historical perceptions of marketing ethics. The book is accompanied by a companion website including: PowerPoint slides and teaching notes per chapter, links to free SAGE journal articles and online videos selected per chapter by the authors, quizzes per chapter and links to further reading online. Debating the Ethics of Immigration PDF
By:Christopher Heath Wellman,Phillip Cole
Published on 2011-09-30 by OUP USA

Do states have the right to prevent potential immigrants from crossing their borders, or should people have the freedom to migrate and settle wherever they wish? Christopher Heath Wellman and Phillip Cole develop and defend opposing answers to this timely and important question. Appealing to the right to freedom of association, Wellman contends that legitimate states have broad discretion to exclude potential immigrants, even those who desperately seek to enter. Against this, Cole argues that the commitment to the moral equality of all human beings - which legitimate states can be expected to hold - means national borders must be open: equal respect requires equal access, both to territory and membership; and that the idea of open borders is less radical than it seems when we consider how many territorial and community boundaries have this open nature. In addition to engaging with each other's arguments, Wellman and Cole address a range of central questions and prominent positions on this topic. The authors therefore provide a critical overview of the major contributions to the ethics of migration, as well as developing original, provocative positions of their own.

Principles of German Criminal Procedure PDF
By:Michael Bohlander
Published on 2012-02-01 by Bloomsbury Publishing

The book aims to outlinie the fundamental aspects of the German approach to criminal procedure; it is meant as a companion volume to the author's earlier publications, 'The German Criminal Code - A Modern English Translation', and 'Principles of German Criminal Law', also with Hart. In appropriate cases, comparisons to English and Welsh law have been drawn. The chapters cover a wide range of issues from setting out the basic procedural principles to presenting the main players in the criminal justice system, pre-trial investigations, the path from indictment to trial judgment, rules of evidence, sentencing, and appeals and post-conviction review. As far as it is useful for an introductory text, the differences between proceedings against adults and juveniles are highlighted. The theoretical discussion of decision-making and style of judgment writing is supported by practical insights through specimen translations of an indictment, a trial judgment and an appellate judgment by the Federal Court of Justice.

The Design of Life PDF
By:William A Dembski,Jonathan Wells
Published on 2008 by Foundation for Thought and E

When future intellectual historians list the books that toppled Darwins theory, The Design of Life will be at the top. So writes Lehigh biochemist Michael Behe, a leading critic of Darwinism and proponent of intelligent design. The scientific community continues to wrestle with deep and fundamental questions: Where did the universe come from? How did life originate? How did a coded language like our DNA come to form the basis of life? How could multicellular life form so suddenly from unicellular life? What is the origin of the complex molecular machines, essential to life, which are inside every cell of our bodies? The Design of Life gives all interested parties in the debate over biological origins the hard scientific evidence they need to assess the true state of Darwins theory and of the theory of intelligent design. But it does much more: it carefully fosters the attitude of open inquiry that science needs not only to thrive but also to avoid becoming subservient to special interests. In this book, authors William Dembski and Jonathan Wells empower readers to navigate the captivating and controversial waters of biological origins. The Design of Life has nine chapters, each of which is accompanied by Endnotes and Discussion Questions. The ninth, an Epilogue, is followed by a 12-page Glossary and a 14-page Index. The General Notes on an accompanying CD supply each chapter with additional analysis and discussion at a more advanced level. A Foreword by University of South Dakota biologist William S. Harris introduces the book. Chapter 1 Human Origins. This chapter addresses key topics in human origins - the 98% gene identity (base sequences) between chimpanzees and humans, the significance of brain size to intelligence, the uniqueness of human language, and the challenge that altruism poses to evolutionary ethics. Chapter 2 Genetics and Macroevolution. This chapter examines Darwins theory of evolution, Mendelian inheritance, the adaptational package, the molecular basis for genes and evolution, and evolutionary developmental biology (Evo-Devo).Chapter 3 The Fossil Record. This chapter examines major patterns in the fossil record, the failure of Darwins theory to match up with these patterns (a failure Darwin himself regarded as the gravest objection to his theory), and why fossils alone cannot establish evolutionary lines of descent. Chapter 4 The Origin of Species. This chapter describes theories about how new species originate. It explains the critical distinction between evidence for small changes and claims about vast transformations (micro- vs. macroevolution), It also explains why the current examples of alleged new species (observed speciation) provide no evidence for macroevolution.Chapter 5 Similar Features. This chapter discusses analogy and homology do things look alike because they do the same job, like scissors, or because they are related, like siblings? The puzzling story of the pandas provides a useful illustration. It also looks at molecular phylogeny, vestigial structures, and the discredited story of recapitulation.Chapter 6 Irreducible Complexity. This chapter discusses biochemist Michael Behes concept of irreducible complexity and then applies it to molecular machines inside the cell, such as the bacterial flagellum. Conventional evolutionary explanations (coevolution and co-option) are contrasted with intelligent design explanations, which are seen as more powerful and scientifically fruitful. Chapter 7 Specified Complexity. This chapter characterizes specified complexity as an information-theoretic property of structures that places them beyond the reach of chance-based explanations (such as natural selection and random variation). It then applies the theory of specified complexity to biological systems, demonstrating their actual design.Chapter 8 The Origin of Life. This chapter describes why the origin of life is such a difficult problem and examines the main materialistic proposals (Oparins Hypothesis, the Miller-Urey experiment, the RNA world, self-organization, molecular Darwinism). It summarizes the failure to find a non-intelligent origin.Chapter 9 Epilogue: The Inherit the Wind Stereotype. The Epilogue examines key social interpretations of the issues: The movie Inherit the Wind (Hollywoods stereotype of the Scopes Monkey Trial), the actual Scopes Trial, the importance of keeping science honest, and the 2005 Kitzmiller v. Dover trial.

The Nasirean Ethics PDF
By:Nasir Ad-din Tusi
Published on 2011 by Routledge

The Nasirean Ethics is the best known ethical digest to be composed in medieval Persia, if not in all mediaeval Islam. It appeared initially in 633/1235 when Tūsī was already a celebrated scholar, scientist, politico-religious propagandist. The work has a special significance as being composed by an outstanding figure at a crucial time in the history he was himself helping to shape: some twenty years later Tūsī was to cross the greatest psychological watershed in Islamic civilization, playing a leading part in the capture of Baghdad and the extinction of the generally acknowledged Caliphate there. In this work the author is primarily concerned with the criteria of human behaviour: first in terms of space and priority allotted, at the individual level, secondly, at the economic level and thirdly at the political level.

Ethics and Values in Social Work PDF
By:Allan E. Barsky
Published on 2009-10-14 by Oxford University Press

In a unique and student-friendly package, Ethics and Values in Social Work offers a series of learning modules that will ensure graduates receive a comprehensive ethics and values education. Designed to be easily incorporated into any curriculum, each module helps students integrate the knowledge, skills, self-awareness, and critical thinking abilities required for dealing with ethical issues. From applying basic ethical standards of practice to managing complex ethical dilemmas, this textbook equips readers with a range of tools and strategies for responding to ethical questions and concerns. Traditional ethics textbooks provide students with a model for ethical decision making. This breakthrough textbook goes beyond ethical decision making by providing students with a strategic framework for managing ethical issues that includes guidelines for engaging others in ethical discussions and using conflict resolution theory to promote collaborative solutions. Some textbooks introduce students to ethical theories, such as deontology, teleology, and virtue ethics. This textbook goes beyond describing these theories by providing students with opportunities to apply, compare, and contrast these approaches as they relate to various contexts of social work practice. A wealth of case scenarios, discussion questions, and role-play exercises make this an engaging, thought-provoking teaching and learning tool. At a basic level, this textbook teaches students the essential principles and standards that define ethical practice. At a more profound level, Ethics and Values in Social Work inspires students to reach for the highest values of profession: service, dignity and worth of the person, human relationships, integrity, competence, social justice, human rights, and scientific inquiry.

Ethics in Psychology PDF
By:Gerald P. Koocher,Patricia Keith-Spiegel
Published on 1998 by Oxford University Press, USA

Psychologists today must deal with a broad range of ethical issues--from charging fees to maintaining a client's confidentiality, and from conducting research to respecting clients, colleagues, and students. As the field of psychology has grown in size and scope, the role of ethics has become more important and complex whether the psychologist is involved in teaching, counseling, research, or practice. Now this most widely read and cited ethics text in psychology has been revised to reflect the ethics questions and dilemmas that psychologists encounter in their everyday work. Ethics in Psychology has been completely updated in response to evolving trends in psychological research and practice, as well as extensive changes in the American Psychological Association's ethics code. Gerald P. Koocher and Patricia Keith-Spiegel take a practical, commonsense approach to ethics in modern-day psychological practice, and offer constructive suggestions for both preventing problems and resolving ethical predicaments. In this book, their main intent is to present the full range of contemporary ethical issues in psychology as not only relevant and intriguing, but also as integral and unavoidable aspects of the profession. The authors make extensive use of actual case studies in order to illustrate how the APA guidelines apply to specific situations, such as fee setting, advertising for clients, research ethics, sexual attraction, classroom ethics, managed care issues, confidentiality, and much more. The most recent ethics code of the American Psychological Association (1992) is used here only as a starting point. The authors go well beyond the APA code and incorporate the input of many experts. In addition to the analysis of a wide variety of general situations, new problematic areas are identified and explored. The book includes two appendixes - Ethical Principles of Psychologists and Code of Conduct, adopted by American Psychological Association, Rules and Procedures of the Ethics Committee of the American Psychological Association - both in an easy-to-use format. In addition, each chapter lists summary guidelines along with current and valuable references. Highly readable, the book unites a straightforward, lively writing style with humorous anecdotes that highlight the human side of ethics and make the book a pleasure to read. Ethics in Psychology will be an indispensable guide to ethical decision-making for all psychologists and students in psychology.

Ecological Ethics PDF
By:Patrick Curry
Published on 2011-08-29 by Polity

In this thoroughly revised and updated second edition of the highly successful Ecological Ethics, Patrick Curry shows that a new and truly ecological ethic is both possible and urgently needed. With this distinctive proposition in mind, Curry introduces and discusses all the major concepts needed to understand the full range of ecological ethics. He discusses light green or anthropocentric ethics with the examples of stewardship, lifeboat ethics, and social ecology; the mid-green or intermediate ethics of animal liberation/rights; and dark or deep green ecocentric ethics. Particular attention is given to the Land Ethic, the Gaia Hypothesis and Deep Ecology and its offshoots: Deep Green Theory, Left Biocentrism and the Earth Manifesto. Ecofeminism is also considered and attention is paid to the close relationship between ecocentrism and virtue ethics. Other chapters discuss green ethics as post-secular, moral pluralism and pragmatism, green citizenship, and human population in the light of ecological ethics. In this new edition, all these have been updated and joined by discussions of climate change, sustainable economies, education, and food from an ecocentric perspective. This comprehensive and wide-ranging textbook offers a radical but critical introduction to the subject which puts ecocentrism and the critique of anthropocentrism back at the top of the ethical, intellectual and political agenda. It will be of great interest to students and activists, and to a wider public.
